Metso PumpDim license agreement
Important - Please read carefully the Metso License Agreement before proceeding. If you do not agree to its terms and conditions, please return the license agreement and all accompanying materials without further opening or using them. Return them to the supplier from which you obtained them. Further opening or use of the materials indicates acceptance of the terms and conditions of the license agreement.
License terms and conditions
1. Grant
Metso Minerals (Sweden) AB (hereinafter “Metso”) grants you a limited, non-exclusive and non-transferable right to use the pump sizing software developed by Metso (hereinafter the “PumpDim Software” or “Software”) on a single computer for the purpose of selecting a correct pump to be supplied by Metso. You may copy the PumpDim Software into the local memory or storage device of the single computer or onto a network server for use by users registered with Metso. You may not use the Software for any other purpose than what is defined in this license agreement.
You may not grant or transfer your rights or obligations according to this agreement.
2. Copyright
The PumpDim Software is owned by Metso and its suppliers and is protected by copyright laws and international treaties. Your use of the PumpDim Software and associated documentation is subject to the applicable copyright laws and the express rights and restrictions of this license agreement.
3. Restrictions
You may not remove any copyrights, trademark, or other proprietary notices from the PumpDim Software or the media. You may not reverse engineer, decompile, or disassemble the PumpDim Software, except to the extent Metso cannot prohibit such acts by law. In addition you may not modify or further develop PumpDim Software.
Except as explicitly provided above you may not copy the PumpDim Software or pass it on, or otherwise disclose it, to a third party.
Upon Metso’s request you shall immediately cease to use the PumpDim Software and remove the software from your computer or server.
Limited Warranty
Metso’s entire liability and your exclusive remedy for any defect in the PumpDim Software shall be periodic updates for registered users replacing the previous release of the software. Availability and frequency of updates shall be at Metso’s sole discretion. Metso excludes all warranties, whether express or implied, to the fullest extent permitted by law including but not limited to all warranties as to fitness for particular purpose, quality, and non-infringements of intellectual property rights of third parties. In particular, but without prejudice to the generality of the foregoing, Metso does not warrant that the Software will meet user’s requirements, or will operate in combination with any other programs or products that any user selects or has, or that the operation of the Software will be uninterrupted or error-free.
Any information gained from the software is advisory only, and implies no legally binding offer or warranty, unless expressly confirmed in writing by Metso.
Allocation of Liability
Metso’s total liability to you for any cause whatsoever shall be limited to periodic updates for registered users replacing the previous release of the software. This limitation will apply regardless of the form of action, whether in contract or tort, including without limitation negligence. In no event shall Metso be liable for any damages resulting from loss of data or use, lost profits, or any indirect, incidental or consequential damages.
User/Licensee Declaration
By clicking "Accept" the person downloading the Software confirms that he has read and understands the above License Agreement, and agrees to adhere to the license terms and conditions outlined herein.
